Terms of Use

These Terms of Use (TOU) legally govern the access and use of the FODYEM platform services, encompassing its tourism promotion activities, corporate event management, as well as all software modules of its NOLIMIT technological ecosystem.

1. Acceptance of Terms

Any access to the website, interaction with our automated communication channels (such as the WhatsApp virtual assistant powered by Nolimit-Connect), or subscription to any of our offers implies unconditional acceptance of these TOU by the user or the professional client entity.

2. Description of Services and NOLIMIT Ecosystem

FODYEM provides hybrid support services structured around two worlds:

• Cohesion Services: Organization of local stays, team building, event logistics, and corporate professional seminars.
• NOLIMIT Ecosystem Technological Solutions: Provision of advanced digital tools including customer relationship automation via omnichannel channels (WhatsApp, SMS, intelligent bots via Nolimit-Connect), unified billing and collection architectures (Nolimit-Pay), application Artificial Intelligence bricks (Nolimit-IA), and strategic consulting (Nolimit-Consulting).

3. Specific Rules of Use for Messaging Modules (Nolimit-Connect)

In the context of using our modules connected to the WhatsApp Business API, the user expressly agrees to:

• Not use our servers and automated messaging channels for the distribution of unsolicited advertising content (Spam).
• Strictly comply with Meta Business's commercial policy regarding the use of WhatsApp APIs.
• Not impersonate any identity or transmit data that is insulting, illegal, or compromises the security of the FODYEM network.

4. Transactions and Billing (Nolimit-Pay)

The centralized payment module Nolimit-Pay allows for secure payment of client invoices. FODYEM uses encryption protocols compliant with financial industry standards. The user is responsible for the validity and authorization of the payment methods deployed at the time of the transaction.

5. Intellectual Property

All trademarks, logos, graphics, software patents, algorithmic structures, source codes, as well as the terminology associated with the NOLIMIT ecosystem are the exclusive property of FODYEM. Any reproduction or external integration without prior written consent will be subject to legal action.

6. Limitation of Liability

FODYEM makes its best efforts to ensure maximum availability of its software services. However, we cannot be held liable for any temporary service interruptions related to infrastructure maintenance operations or third-party network failures (notably outages or technical restrictions applied directly by Meta or telecommunications operators).

7. Applicable Law and Jurisdiction

These TOU are governed by the legislation in force in Senegal. Any dispute regarding their interpretation or the use of our digital services, which cannot be settled amicably, shall be submitted to the exclusive jurisdiction of the courts of Dakar.
